What Does "Pending" Mean?

As of early 2008, the OSDV Foundation is a “pending” 501(c)(3) organization. What this means is that you, as a prospective contributor are free to make donations on the basis of your personal decision to do so absent our IRS Determination Letter and with the possibility we could be denied tax exempt status.

We have sought out legal and accounting advice and counsel in preparation of our applications and we trust their work. Therefore, we believe we will be determined tax exempt, and expect that to occur before the end of September 2008. However, you should not rely on our beliefs alone.

Consult your accountant or attorney before making any decision to donate to this Foundation. And you are free to examine our IRS 1023 Tax Exempt Application (including the Form 1023 filing document, the filing addenda, and the Form 2848), and our filing receipt from the IRS,  before reaching your own conclusion about whether we will be deemed exempt by the IRS this year.

This Foundation's tax-exempt status, if and when granted, will be retroactive to the formation date of the Foundation: 21 April 2007.
